4.4. Sundays, Public Holidays and Rental Cessation.
For Sundays and public holidays, rental shall be calculated as for a weekday, regardless of whether the day is a public holiday or similar. If the machine is used during a period in which rental cessation has been agreed, rental shall be calculated for the entire period.
4.5. Costs in Connection with Downtime
Costs arising as a result of the above circumstances shall be of no concern to the Lessor, regardless of the reason for their occurrence. Accordingly, the Lessee shall bear all costs incurred in connection with the downtime, including any claims, indirect or direct costs, charges or fines incurred by the Lessor.
4.6. Orders, Charges, Taxes, etc
In addition to the above-mentioned costs, the Lessor shall be entitled to pass on to the Lessee any cost arising from an order, charge, tax or similar. The Lessor shall be entitled to require confirmation that such matters have been investigated and documented before erection.
The Lessee is responsible for ensuring that there is sufficient space at the assembly site for the erection and dismantling of the rented equipment. The Lessee is responsible for ensuring that the rented equipment can be dismantled after use, and the Lessee must therefore take this into account when designating the assembly site.
This requires, among other things, that there is sufficient space for the transport and loading equipment chosen by the Lessor, normally crane truck, truck, low-loader, forklift and, where applicable, mobile crane. The mobile crane must be capable of being positioned within a radius of 15 meters from the
assembly site. Reference shall always be made to the order confirmation, as each assembly/dismantling operation is different.

In connection with the erection and dismantling of cranes, the Lessee shall make personnel available. The Lessee is responsible for any assistance required during the assembly/dismantling. Where erection is carried out on a foundation, the foundation must be cast and cured. Where erection is carried out on an embedded mast/anchor, the mast/anchors must be embedded in the foundation and cured.
Where assembly is carried out on bogies, a minimum of 12
meters of crane track must be laid on a load-bearing surface. The above-mentioned works shall be carried out by the Lessee, who shall also bear the costs thereof.
6.7. Costs Arising from Preparation
If the Lessor assesses that one or more of the above conditions have not been met, the Lessor may, at the Lessee’s expense, either remedy the matter or suspend the assembly/dismantling.
In this connection, the Lessor may, among other things, order: levelling of the ground surface, additional auxiliary equipment such as a mobile crane, driving plates for the access road or machine foundation, temporary site power, etc.
Regardless of whether the Lessor remedies the matter or suspends the assembly/dismantling, the Lessee shall be obliged to pay all resulting costs in addition to those stated in the agreement, including waiting time, additional transport, cable rental, etc.

§ 9. Repair and Maintenance
9.1. Ordinary Wear and Tear and Maintenance

11.4. Property Damage and Personal Injury
The Lessee is obliged and responsible for ensuring that the rented equipment is covered by liability insurance taken out by the Lessee, covering the Lessee’s use of the rented equipment. The insurance must cover the Lessee’s liability for personal injury and property damage arising from the use of the rented equipment.
Theft of and vandalism to the rented equipment must be reported to the Lessor and the police within 24 hours of the incident. Damage to the rented equipment must likewise be reported to the Lessor within 24 hours from the time the damage is or ought to have been discovered.
§ 12. Operating Loss
12.1. Liability
The Lessee alone shall bear the responsibility and risk for any operating loss of any kind, loss of profit, loss of time, any other direct or indirect loss, or consequential damage, regardless of the cause thereof, whether direct or indirect, including where caused by downtime, defects or deficiencies in the rented
equipment, or as a result of delay in the delivery, servicing or collection of the rented equipment.
Furthermore, the Lessor shall never assume liability for work
stoppages, machinery damage or delays resulting from war, fire, strikes of any kind, lockout, intervention by public authorities or public orders, including orders issued by the Danish Working Environment Authority, precipitation, low temperatures, wind or other weather conditions that fully or partially interrupt operations.
§ 13. Professional Liability
13.1 Application
The following professional liability shall only apply if the Customer orders a separate advisory service from the Lessor, and a written agreement to that effect has been entered into between the parties. The Advisor shall only be liable for the specific advice provided, and the Lessee shall therefore be responsible for the application of the advice provided.
The Advisor’s professional liability shall be limited to a maximum amount equal to the fee payable under the separate agreement. The aforementioned limitation of liability shall apply regardless of whether the Lessee’s ordering of the advisory service forms part of any other service ordered by the Lessee or by a third party, or not.
